Terms and Conditions

1.    Definitions: In these Terms of Conditions, unless the context otherwise requires:-

 

(a)           “The Sender” or “The Customer” shall mean the person requesting the delivery of a message.

(b)          “The Recipient” shall mean the organisation or person to whom the message is to be sent or delivered.

(c)          “Couriergram” shall mean the service provided by Couriergram Ltd to deliver messages for the Sender in written form.

(d)          “The Company” shall mean Couriergram Ltd.

 

2.    Two Hour Delivery Guaranteed

The Company agrees to deliver the message to the Recipients address, as given by the Sender within two hours to addresses in the UK mainland including Northern Ireland and the IOW that are accessible by a hard metalled road. Should neither the Recipient nor anyone else be at the Recipient's address or appear not to be at the Recipient’s address, then the telegram message will be left there with the time of delivery endorsed by the person making the delivery on behalf of The Company. Telegrams for the Two Hour Guaranteed Delivery will be delivered during our opening hours between 0900 and 1800 Monday to Saturday, Telegrams outside these times can be sent from the web site but will not be delivered until the day of our next opening time, by 11.00.

 

3.    Same Day Guaranteed Delivery

The Company agrees to deliver the message to the Recipients address, as given by the Sender the Same Day to addresses in the UK mainland including Northern Ireland and the IOW that are accessible by a hard metalled road. Should neither the Recipient nor anyone else be at the Recipient's address or appear not to be at the Recipient’s address, then the telegram message will be left there with the time of delivery endorsed by the person making the delivery on behalf of The Company. Telegrams for the Same Day Guaranteed Delivery will be delivered during our opening hours between 0900 and 1800 Monday to Saturday, Telegrams outside these times can be sent from the web site but will not be delivered until the day of our next opening time.

 

4.   Next Day Guaranteed Delivery

 

The Company will despatch the telegram for guaranteed next day delivery Monday to Friday only, excluding all national holidays. A signature on delivery is required with this service. If a signature cannot be obtained the telegram will be returned to the nearest office, a note will be left with the recipient advising that a delivery is waiting for them with options to arrange alternative delivery. The cut off time for Next Day Guaranteed Delivery is 1600 Monday to Friday.

 

5.   Next Day Delivery

 

The Company despatch the telegram for next day delivery Monday to Friday only excluding all national holidays. This service is not guaranteed next day delivery. The cut off time for Next Day Delivery is 1600 Monday to Friday.

 

 

6.   International Delivery

 

The Company will despatch the Telegram to the country concerned immediately. If going to a private address delivery is approximately 24 to 72 hours. If going to a hotel or resort delivery is often the same day. There is no guaranteed delivery performance for International Telegrams as regional time difference and local conditions may cause delays. The cut off time for International Delivery is 1600 Monday to Friday.

 

7.   Should the Company fail to deliver the message within the relevant period of time The Company shall refund to the Sender the fee paid by the Sender only SUBJECT to the time constraints stated in sections 2 to 5. and to the following provisions:-

 

(a)          The Company shall not be responsible for any loss in excess of the fee paid by the Sender as a result of late or non delivery or for any other reason.

(b)          The Company shall not be liable for delays outside its control, events shall include (without limitation) any strike, lock-outs, trade disputes, computer system corruption or failure, internet failure, road traffic conditions, road traffic accidents, weather, flood, tempest, war or act of God, civil disorder or uprising, or any other cause which prevents delivery by the nearest hard metalled road route to the address of the Recipient.

(c)          For deliveries to Hotels, Public buildings or any building with a reception, porter or security, collectively termed hereinafter ‘the reception’, The Company will deliver where possible to the reception. The Company accepts no liability for the reception not passing the message on to the named Recipient.

(d)          The Company will in normal circumstances transmit the message to their delivery office via a data file. Should this system fail, or in emergency situations, the Company reserves the right to transmit the message to their delivery office by any means at their disposal to include, but not exclusively: fax, telex or other electronic or analogue methods. Should this be the case the Company reserves the right to deliver the message in black and white rather than colour.

(e)           Orders can be taken through the website 24 hours a day. Orders will be delivered in accordance with the time constraints stated in sections 2 to 5.

(f)            During periods of Postal Strike, whether National or Regional, the only delivery option will be same day service.

(g)           The Company retains the right to refuse to deliver any message that, at its sole discretion considers to be obscene, racist, sexist or is likely to cause offence. In any event The Sender remains liable at all times for the content of the message and will indemnify the Company in full for all and any claims resulting from the message content and any graphical images therein attached. The Company reserves the right in its absolute discretion to refuse any message without stating a reason.

 

8.    Accuracy of Senders instructions: Where The Company accepts a message for delivery from The Sender or any person on the authority of The Sender, The Sender warrants:-

(a)          The accuracy of the message.

(b)          The address of the Recipient given is the full postal address and is accessible by a hard metalled road.

(c)          Neither the message nor the address is in any way misleading.

 

9.    Users who have registered with the site give their permission for the company to use their emails to send the user news, offers, information or notifications by e-mail.
